1. About these terms
These terms and conditions ("Terms") govern your use of the BONÈ Agency product catalog website and any purchase you make through it. By placing an order, you agree to these Terms. BONÈ Agency ("BONÈ," "we," "us") is a lifestyle brand based in Kralendijk, Bonaire, Caribbean Netherlands.
2. Products and pricing
All products, descriptions, images, and prices displayed on this website are subject to change without notice. We make every effort to ensure accuracy, but occasional errors may occur. If we discover an error after you have placed an order, we will contact you before processing it. Prices are shown in USD unless otherwise stated and include applicable local taxes where required.
3. Orders and acceptance
Submitting an order constitutes an offer to purchase. Your order is confirmed when you receive an order confirmation email with your unique order number. We reserve the right to refuse or cancel any order — for example, if an item is unavailable, if payment is not received within the stated timeframe, or if we suspect fraudulent activity.
4. Payment
Payment is by bank transfer only. After checkout, you will receive payment instructions including our IBAN, account name, and a payment reference that must be included with your transfer. Production begins once payment is received and verified. Orders with unpaid balances after 7 days may be cancelled automatically.
5. Custom and printed apparel
Many BONÈ products are custom-printed or made to order. By purchasing these items, you acknowledge that production timelines may be longer than for standard stock items and that custom-printed goods are generally not eligible for return except in cases of manufacturing defect or error on our part. You are responsible for providing accurate artwork and approving proofs for bulk custom orders before production begins.
6. Delivery and pickup
We offer local pickup and island delivery on Bonaire. Delivery timeframes are estimates, not guarantees. Risk of loss passes to you upon pickup or delivery to the address you provide at checkout.
7. Intellectual property
All BONÈ logos, designs, photography, and website content are owned by BONÈ Magazine or its licensors. You may not reproduce, distribute, or use our intellectual property without written permission. If you supply artwork for custom printing, you confirm that you have the right to use it and indemnify BONÈ against any third-party claims arising from its use.
8. Limitation of liability
To the fullest extent permitted by law, BONÈ is not liable for indirect, incidental, or consequential damages arising from your use of this website or any product purchased through it. Our total liability for any claim related to an order is limited to the amount you paid for that order.
9. Governing law
These Terms are governed by the laws of the Caribbean Netherlands. Any disputes shall be submitted to the competent courts in Bonaire, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
